Small Creditors : finally no more Be-Sahara ?

 Context :

Government launches portal to help small-time investors of Sahara group’s cooperative society  . . Hindu / 18 July 2023

Union Home and Cooperation Minister Amit Shah on July 18 launched a portal to refund the money of around four crore small-time investors of four cooperative societies linked to the Sahara group of companies.

Launching the portal on the Ministry’s website, Mr. Shah said that 1.7 crore investors will benefit in first phase and claims upto ₹10,000 will be settled first. The money will be returned to the Aadhaar-linked bank accounts of the investors within 45-days, he said.

“Small investors are hit the most. Take the example of Saharacase dragged on for many yearsseveral agencies seized their assets. We invited all stakeholders including SEBI, ED, CBI, SFIO. Asked, can we devise a system for the benefit of small investors. All agencies filed a petition in Supreme Court which took a landmark decision that if all agencies agree, a committee under retired SC judge will monitor the reimbursement,” Mr. Shah said.

On March 29, the Supreme Court ordered the refund from Sahara-SEBI refund account to about 10 crore investors of the four cooperative societiesThe court was requested that ₹5,000 crore from the Sahara-SEBI Refund Account may be used to pay depositors

We will begin with ₹5,000 crore, once this is exhausted, we will approach the SC again. There is no scope of any fraud, those who have no invested will not get any kind of refund Many investors may not know how to use the use the portal, they can go to the nearest Common Service Centre and seek assistance,” Mr. Shah said.

Depositor Registration Process :

 

Step 1

 

For Depositor Registration, you need to enter 12 digit Membership Number, last 4 digit Aadhaar Number, 10 digit Aadhaar linked Mobile Number, captcha and press on “Get OTP”

 

Step 2

 

Enter the OTP received on Aadhaar linked Mobile Number and complete the Registration process.

 

 

 

Depositor Login Process :

 

Step 1

 

On Depositor Login Screen, enter last 4 digit Aadhaar Number, 10 digit Aadhaar linked Mobile Number, captcha and press on “Get OTP”.

 

Step 2

 

Enter the OTP received on Aadhaar linked Mobile Number.

 

Step 3

 

Once Depositor Logged in, Depositor will see Aadhaar Consent Screen. Move to next Page after Accepting the terms and conditions by clicking on “I Agree” button

 

Step 4

 

On Personal Details Screen, enter 12 Digit Aadhaar Number and click on “Get OTP”. Depositor will receive OTP on Aadhaar linked Mobile Number

 

Step 5

 

Enter OTP and press on Verify OTP

 

Step 6

 

After Verifying OTP, the system displays the Aadhaar user details like First Name, Middle Name, Last Name, Date of Birth, Father/ Husband Name

 

Step 7

 

Also user can enter Email then click on “Save Email” and press “Next” button.

 

Step 8

 

Depositor will enter details as displayed on the screen

 

Step 9

Click on “Add Claim” Button and Depositor will see all details in the below grid. Here, Depositor will be able to add multiple Claim Details.

 

Step 10

 

Once all Claim details are entered, Generate Prefilled Claim Request Form. “Please ensure that all claims have been entered, before generating forms. After which Depositor will not be able to make any changes or make additional claims.”

 

Step 11

 

Affix the recent photograph and duly sign across the photo as well as the Claim form.

 

Step 12

 

On the “Upload Documents” Screen, upload the Claim Form and PAN Card copy. (PAN Card is mandatory, if Claim Amount is Rs.50,000 or above.) Note: Size limit for Signed Claim request form with affixed photograph and PAN Card is 2MB and 50KB respectively

 

Step 13

Thank you Page will display with a Claim Request Number. Kindly note the Claim Request Number for future reference

My Take :

 

 

Dear Amitbhai Shah :

 

 

Congratulations for this long overdue initiative to help our small depositors of SAHARA group fraud

I urge you to :

 

 

Ø Have a COMMON PORTAL for all small depositors of all such fraudulent groups ( a depositor does not have to search among a hundred similar portals, each dedicated to one society / chit fund )

 

Ø Simplify the Depositor Registration and Login Process ( may be just 2 screens )

 

 

Of course , launch of this portal is unlikely to get thousands of “ Fraudulent Depositors “ described in my following 9 YEAR old blog , to come forward and lodge their claims !

 

You are unlikely to have to refund that Rs 5,000 crores and will have no need to approach the Supreme Court to release more funds

 

Incidentally , with interest earned by the various Govt Agencies over the past 9 YEARS, can you tell the public , how much is the TOTAL AMOUNT , as of now ?

These days , Sahara-Shree Subroto Roy seems to be , Be-Sahara Shree  !

 

 

He is in jail for past 3 months or so

 

 

And Supreme Court won't let him out on bail , unless he deposits Rs 5,000 Crores in cash and furnish a surety bond of an equal amount

 

 

Then within a few weeks , Supreme Court wants him to hand over to SEBI , Rs 24,000 Crores that SEBI claims he raised illegally from " Public "

 

 

But Subroto says ,

 

 

 

" What public  ?

 

 

  I am ready to pay-off all of my depositors , if only , they would come forward to claim their deposits

 

 

I have raised , a few rupees each ( Rs 5 - Rs 10 ), from millions of small depositors , all of whom , gave their postal address as , " Delhi-Agra Road ", or  " Kanpur - Lucknow Road "

 

 

I just can't find them  "

 

 

 

Now , all of us ( Supreme Court and SEBI included ) , know that ,

 

 

>  Those Rs 24,000 Crores belong to politicians ( - most who got defeated in

     recent Lok Sabha elections ) , businessmen / bureaucrats / film stars etc

 

 

>  Each of them have given this in CASH to Sahara-Shree ( Range : Rs 10 -

    100 crores )

 

 

>   Sahara-Shree knows that they don't dare to publicly ask him to return

     their deposits . He managed to render them be-sahara  !

 

 

>   Neither Sahara , nor SEBI have true addresses of those fake depositors

 

 

 

So , what happens now  ?

 

 

>   Subroto will be forced to sell most of his properties to raise money

 

 

>   To ensure that there is no hanky-panky in sale of these properties ,

      Supreme Court may appoint some world-famous Real Estate

      Consultants to conduct e-Auctions for each of these assets

 

 

>    SEBI will have a windfall of Rs 24,000 Crores that no one wants  !

 

 

>    SEBI will deposit it with banks and earn a fat interest - for ever

 

 

 

I would say , a smart way to convert BLACK money into WHITE money  !

Two days back , newspapers reported that ,

 

*  By selling off the properties of Subroto Roy ( Sahara ), SEBI has managed to recover some Rs 11727 Crores

 

*  But it could find only a FEW claimants and could refund only Rs 55 crore so far !

 

 

Altogether , SEBI is claiming some Rs 37,000 crore from Subroto ( considering interest on those Rs 24,000 cr due to SEBI , 2 years back !
