FW: DATA PROTECTION LAW : NEEDS RELOOK


Dear Shri RaviShankar Prasadji,

[ Minister for Law and Information Technology ; Govt of India  ] 

No single nation can protect its citizens against DATA PIRACY / MISUSE , by the web sites and mobile apps , all by itself

This is because :


* Technologies to hack the web sites for private data , are rapidly expanding and no legislation ( of any single country ) can stop that


* Every day , new sites and apps are cropping up - some actually making lives simpler / easier .  Must not stop persons from using the same


* Web sites have to make money to survive in order to continue providing services


In following blog , Tim Berners-Lee [ timbl@w3.org ] suggests an alternative which India must support


Contract  for  the  Web

Today [ 05 Nov 2018 ], at the Web Summit, Tim and Web Foundation CEO Adrian Lovett launched the Contract for the Web, an initiative to ensure governments, companies and citizens around the world help protect the open web as a public good and a basic right for everyone

Principles for a Contract for the Web


 

By committing to the following principles, governments, companies and citizens around the world can help protect the open web as a public good and a basic right for everyone


 

The Contract Principles are :

 

Governments will


Ensure everyone can connect to the internet
So that anyone, no matter who they are or where they live, can participate actively online.
Keep all of the internet available, all of the time
So that no one is denied their right to full internet access.

Respect people’s fundamental right to privacy
So everyone can use the internet freely, safely and without fear.


Companies will

Make the internet affordable and accessible to everyone
So that no one is excluded from using and shaping the web.

Respect consumers’ privacy and personal data
So people are in control of their lives online.

Develop technologies that support the best in humanity and challenge the worst
So the web really is a public good that puts people first


Citizens will

Be creators and collaborators on the web
So the web has rich and relevant content for everyone.

Build strong communities that respect civil discourse and human dignity
So that everyone feels safe and welcome online.

Fight for the web
So the web remains open and a global public resource for people everywhere, now and in the future.

Web founder wants contract to rebuild trust on internet



Tim Berners-Lee has just launched Inrupt, a start-up which is building an open-source platform called “Solid” which will de-centralize the web and allow users to choose where their data is kept, along with who can see and access it.


He called on companies and governments to find NEW WAYS to monetize, regulate and ensure fair and affordable access to the online world




Is it possible for individual net users to :
Control  “ WHO “ can see / access “ WHAT “ of their “ PERSONAL “ data ?

Monetize such access / use of their personal data by commercial entities ?

Yes !
What I have conceptualized  below  can be “ globalized “ :

Only way to protect our ONE BILLION citizens ( from misuse of personal data ) is :

#   Terminate the legal validity of those 100 BILLION “ individual contracts “ [ 1 billion
     persons x 100 web sites , vide :  “ I accept TERMS & CONDITIONS “ clicks on sites ]


#   On behalf of these 1 Billion Indian citizens , government ( Data Protection Regulator
       DPR ) to enter into consolidated contracts with those 100 web sites


#   Web sites not willing to sign such agreement / contract with DPR , must be asked to
     QUIT INDIA ( - if China can do this , why can’t we ? )
