I believe Aadhar related case in Supreme Court was filed by 21 petitioners

They wanted Aadhar ID scheme to be declared unconstitutional and struck down altogether

Hon ( ex ) CJI , Shri Dipak Misraji did not think Aadhar ID, by itself was unconstitutional

But he said , it could be used only for providing certain government “ services “ where direct transfer of money was a major factor

SC ruled that private service providers ( eg : Banks and Mobile Service Providers ) cannot ask for Aadhar ID for KYC ( Know Your Customer ) . They will need to use,

# Either some offline paper based documents ( Passport – Ration Card etc ) , or

# Some modified “ online “ process which does not require to reveal Aadhar Number

I call this ( directive ) , a victory of the rich and vocal “ majority “ of 21 PERSONS , over a poor and silent “ minority “ of 50 CRORE mobile phone users !

I suspect that the rest of the World is thinking :

“ Ah , these Indians !

They have mastered the art of making things COMPLEX , out of matters SIMPLE “

HERE ARE PROOFS :

UIDAI ready with masked Aadhar cards sans number, biometric details

To summarize :

· Hide Aadhar Number / Date of Birth / Biometrics

But provide :

· Name / Address / Photo

Process :

· Log into UIDAI web site

· Download your “ Masked Aadhar ID “ [ click to find ZERO results ! ]

· Submit it to your Mobile service Provider

Telcos seek alternative digital ID process for new subscribers

COAI has sent a letter to telecom secretary Aruna Sundararajan , saying :

“……a return to paper-based process should not be an option as it would reverse the steps taken by the industry towards Digital India and result in wastage of infrastructure and investment “

So , what does COAI suggest as alternatives ?

· Entering various fields in the customer acquisition form electronically on the operator’s app

· Capturing GPS coordinates while capturing the customer’s live photo at the point of sale of the mobile connection

· Watermarking the photo , and

· Assigning a unique operator code so that the photo cannot be copied or re-used.

In the meantime , Shri Manoj Sinha says :

“ The government will fully respect the SC order and, within the legal purview, the government will also take care of consumers ”

I do hope your directive to the TELCOs will be such that :

· It will enable the TELCOs to continue to offer their services , not only to the NEW users , but also to the CURRENT ( 50 Crore ) users, without any interruption

· It will spare the users ( current + new ) , the AGONY of going through the alternatives proposed by UIDAI and COAI ( be ready for ONE YEAR disruption ! )

Even the Supreme Court would be happy to accept your interpretation ( of its order ) that a user has every right to give his Aadhar ID to ANYONE , as long as it is VOLUNTARILY given !

No one need question the user’s motive ( simplifying life ), as long as he sends to his Service Provider , a SMS / E Mail , as per draft provided in :
